The Land and Environment Court is a specialist superior Court with a unique alternative dispute resolution function. The Court’s decisionmakers include Judges, Registrars, Commissioners and Acting Commissioners with various expertise. In this presentation, the Senior Commissioner of the Court, Susan Dixon, will outline the Court’s method of screening and allocating cases to appropriate alternative dispute resolution processes and the role of the Commissioners and Acting Commissioners in assisting parties to reach agreement. Senior Commissioner Dixon will provide examples of the broad range of cases the Court has resolved through alternative dispute resolution, from mundane car park disputes through to development applications for large-scale solar farms. She concludes with a summary of climate change litigation and how the Court is seeing climate change arguments arise in its proceedings. This webinar is offered complimentary to Law Society of NSW members. |
